We are pleased to present you with another Urban Renewal legal update which includes summaries of recent important court and tribunal decisions.
In this update we review the following:
- While the decision on the number of residential units is under the authority of the Regional Committee, this does not mean that it can make its decision in an arbitrary manner.
- A relationship between the developer and the lawyer who represents the apartment owners can amount to a conflict of interest.
- An individual who submits an objection does not have an appeal as of right to the National Committee except if leave to appeal was received from the Regional Planning and Building Committee.
- In the event that a building permit is lost, this does not mean that the building was built illegally. It can be assumed that the buildings were built before 1980 and thus the National Outline Plan 38 applies.
