We are pleased to present you with another Planning and Zoning Law update which contains summaries of recent court and appeal tribunal decisions.
Two matters were recently at the center of discussion in the building and planning field. First, was the Supreme Court decision on whether the VAT component should be included in the calculation of the betterment levy in accordance with the determination on the nature of the market in which a particular transaction is carried out: i.e. a market comprised of individuals, dealers, or a mixed market. The second matter related to the decision of the Planning Administration to evaluate the possibility not to extend the validity of a National Outline Plan 38 which is set to terminate in May 2020.
