On March 15, 2017, the Israeli National Labor Court granted a decision in the matter of an Appeal of Collective Labor Agreement Dispute 55-15-2155 The New Histadrut Labor Federation et al. v. The Municipality of Qalansawe. The decision deals with the right of an employee to privacy at the workplace and the prerogative right of the employer to collect biometric data from its employees. The decision includes the establishment of a number of principles relating to the employees’ rights to privacy, including the prohibition on an employer to coerce its workers to provide biometric data or to collect any such personally identifiable biometric information without their free and informed consent. The decision also describes the necessary conditions for the administration and operation of a biometric database in the workplace.
