Earlier this month the European Court of Auditors published a special report which dealt with the execution of the passenger rights regulations in the European Union (EC261/2004).
The report’s audit team published its findings in the report and more importantly provided recommendations to the European Commission including recommendations on proposals for legislation which could significantly impact execution, enforcement, and protection of passenger rights in the EU.
Also in this legal update, we discuss an appeal which is currently pending before the District Court which could have consequences regarding the possibility to award compensation for distress in the framework of claims for lost or delayed luggage under the Montreal Convention.
