In this Legal Update we review the judgement rendered in Shaul v. Nidaily Communication Ltd. in which the Supreme Court held that “sharing” a post on Facebook can be considered a “publication” under the Prohibition of Defamation Law and, consequently, it will be possible to bring a lawsuit against someone who shares a post, and not only against the original writer of the post. In contrast, “liking” a post will not be considered a “publication” under the law.
In this precedent setting decision, not yet adjudicated in other jurisdictions, the Court deliberates on how the defenses and relief established under the law should be interpreted, taking into consideration the freedom of expression on the internet.
