Recently, the Supreme Court, in the Sonol matter, discussed the considerations for approving “Compensated Withdrawal Settlements” in class action proceedings.
The Court ruled that, when a motion to withdraw from a motion to certify a class action is filed, there is no room to award compensation and attorney fees to the class action applicant and his counsel, and that such compensation and attorney fees can be awarded only when the class action brought before the Court indicates a collective cause of action, and when the class proceeding has brought an actual and relevant benefit to the class members.
